These Mobile Terms supplementary to and incorporated into the Terms of Use (and will be deemed “Supplementary Terms” if such term is defined in the Terms of Use).
Signing Up and Opting-In to the Services
Enrollment in a Service requires you to provide your mobile phone number and to agree to these Mobile Terms. You may need to confirm your consent, such as by replying YES to an initial text message sent to you. You must be a resident of the United States and at least 18 years old in order to enroll in the Services. (Crayola may require you to provide proof of your eligibility.) Crayola reserves the right to modify or stop offering the Services at any time with or without notice.
By opting into a Service, you:
- Authorize Crayola to use an automatic telephone dialing system (also known as an autodialer) or non-auto dialed technology to send recurring text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in). You understand that message frequency may vary.
- Acknowledge that you understand you do not have to agree to receive messages as a condition of purchase.
- Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.
- Confirm that you meet all eligibility requirements for the Service.
- Consent to the use of an electronic record to document your opt-in.
- Agree to notify Crayola immediately if you change or deactivate your mobile telephone number by contacting us at GDPR@crayola.com. You agree to indemnify Crayola (and our parents, affiliates, and subsidiaries) for all claims, expenses, and damages related to or caused, in whole or in part, by your failure to promptly notify us if you change your telephone number while enrolled in the Services, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act and other applicable federal and state laws.
- Understand and agree that Crayola may transition from one short code or telephone number to another, and you consent to receive messages from the new short code or number.

You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Services.
Supported carriers include, but may not be limited to, AT & T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, Alltel, Cincinnati Bell, Cellcom, C-Spire, nTelos, MetroPCS, and other smaller regional carriers. The Service may not be available on all wireless carriers. Crayola may add or remove any wireless carrier from the Services at any time without notice. If your mobile operator is not participating, you will not receive a reply to your messages. Some operators may not support some services (e.g. pre-paid users may not be able to participate). Crayola and mobile carriers are not responsible for any undue delays, failure of delivery, inaccessibility of or error in any mobile network service, or errors in messages.
To Stop a Service
Text the word STOP to 40663 or 78039 any time or reply STOP to any of the text messages you have received from Crayola in order to stop receiving text messages from that short code. After texting STOP to 40663 or 78039, you will receive one additional message confirming that your request has been processed. This will only opt you out of the specific text messaging program associated with that five-digit short code. If you are enrolled to receive both marketing messages (from 40663) and messages about your order(s) (from 78039), you will need to text STOP to both short codes in order completely opt out of receiving recurring text messages from Crayola.
